SB 1383 is a new state legislation focusing on reducing short-lived climate pollutants in landfills through proper waste sorting. In addition to recycling organic materials, businesses are also required to recover edible food.

SB 1383 specifies that certain food related businesses must donate the maximum amount of edible food they would otherwise dispose to food recovery organizations. Tier 1 businesses, such as wholesale food vendors and supermarkets, must have an edible food donation program in place by    Jan. 1, 2022.   Other food businesses will need to have a donation program in place by Jan. 1, 2024.

• 2020 50% reduction in landfilled organic waste
• 2022 regulations take effect
• 2025 75% reduction in landfilled organic waste
• 2025 25% recovery of currently disposed edible food for human consumption

Multi-Family Dwellings

Multi-family dwellings must call Waste Management at (805) 552-9400 to set up an organics recycling program.

Four steps to compliance for businesses and multi-family properties:

1. Contact your waste hauler and subscribe to organics recycling collection service.

2. Set up color-coded and labeled containers in convenient locations for customers, employees and residents. Dining areas of take-out restaurants, building lobbies and other common areas also must have color-coded and labeled bins.

3. Train and educate tenants, residents, employees, contractors and janitors about how to properly sort to ensure requirements are met.

4. Sort into proper containers. Know what materials go where to ensure that there is no contamination in all three containers.

• Produce - Fruits and vegetables
• Meat - bones, shells, fish, beef & chicken
• Dairy - Eggs, yogurt and cheese
• Bakery & Dry Goods - Pasta, beans, rice bread and cereal
• Yard Waste - Grass, leaves and branches (3' diameters or smaller)

Yes.  Waivers are available for businesses or multi-family dwelling depending on certain parameters and criteria.  Waiver requests can be submitted for consideration to info@sws-inc.com.  Waivers are not indefinite, and will be reviewed every five years.   Waivers granted can be rescinded at the determination that refuse collection criteria has changed.
